Kimberly Offenbacher has been practicing for more than 30 years, litigating matters in a variety of substantive areas including personal injury, professional and medical malpractice, labor and employment law and business litigation. She has successfully represented clients through jury trials, bench trials and binding arbitrations, and is a seasoned negotiator on behalf of her clients in mediations and at settlement conferences. In her litigation practice she represents businesses and individuals in lawsuits that arise out of tort and contract and handles both first and third party insurance disputes. Ms. Offenbacher is admitted to practice before all California State Courts, and the United States District Courts for the Northern, Central and Southern Districts of California.

Representative Matters

  • Obtained a published opinion validating a “brush fire” exclusion against a challenge that it was unenforceable under the efficient proximate cause doctrine because the fire had begun by arson
  • Successfully defended physicians against claims of professional negligence through summary proceedings
  • Obtained a six figure judgment with punitive damages, confirmed on appeal, against the prior owners of a pharmacy engaged in fraudulent business practices

Education

Ms. Offenbacher earned her Juris Doctor from Loyola Law School. She received a Bachelor of Arts in sociology, cum laude, from the University of California, Santa Cruz with a minor in environmental studies. She is an active mediator having completed the Straus Institute for Dispute Resolution mediation program and participating as a mediator with Los Angeles County Superior Court MVP.
